My pre-order for Game of Thrones on PS3 disappeared (but the order number still appears under my orders list) when they removed all the coming soon games (which I know the can't honor), so should I get the game from EB Games or JB HiFi.

i saw this coming in early April removed all my pre orders and used up all store credit.... no one sells a company or looking for a buyer when the company is going well!!! anyone burnt by this is either stupid or stupid... sorry to be harsh but its "business" and there is no room for loyalty in the retail industry

And EB just "rented" an island for 3 days for its manager/PR conference [MOG]
So i went to my local GAME store today because i thought i should buy something with the $$ i had on my rewards card..... It had closed down. No warning. I swear i just walked past the other day and it was open. [Rage]

Very unfair.. They should have called the customers who had store credit to come and use it.. Or even an email
I was pretty annoyed because i walked all the way there in the cold.
I assume the card works at any game though so might try somewhere else before they are all gonnnnnneeeeee.

Hopefully.. Even if not I'm sure once you tell them the store closed down it should be ok :)

At least that's the ethical thing to do. Any stores that are still open are trading despite the fact they have retracted their regular exchange/refund store policies, without announcing it anywhere.

I bought 3 cheap games 2 days ago, they told me they had just found out about going into voluntary administration so they told me they could only take cash. Took the games home, turns out one of them was falsely advertised as having 2 player offline co-op which it didnt. Went back today to exchange it, they said nope, can't do it. I said, that's against the law, if something is misleading/falsely advertised, you must give an exchange or refund. They said, nope can't do it....

Went home, called Fair Trading, they sent me here: www.game.com.au/...

They basically said that I can apply to get a refund through PWC, or if GAME exits administration, then I can go back to the store and demand an exchange again. However, I found this very interesting statement:

"For the avoidance of doubt, the withdrawal the Company’s 7 day returns policy does not impact the
consumers’ statutory rights."


My situation is under consumer statutory rights, so I think Fair Trading missed that. I'mma call them up again tomorrow, and if they agree with me, I'm going down tomorrow to my GAME store and slamming this shit down in front of the manager. She was such a bitch to me, so I look forward to it.

Just thought I would write this up in case anyone else is in the same situation.

Seriously? That’s pretty poor on GAMEs behalf, especially if you just wanted to swap the game for another, it’s not like they have to give you any money back (if it’s the same price).

Man I get fair trading and ACCC bullshit thrown at me all day. 99% of the time they quote something they just read it incorrectly.

Misleading advertising is black and white if you can prove it. Check ACCC website.

My situation is black and white. That dumb bitch was just too dumb to realise the difference between a standard change of mind return and statutory obligations. I'd understand if I was trying to get a refund - they have no money. But when it's a matter of swapping one game for another, there is no reason they can't do it, especially when federal law says they must.
